I believe the black "silencer" as many of us call it is also designed to separate any water that splashes up into the air box by pointing the air toward the side of the air box. This forces the air to make a turn prior to going through the filter. As the air makes the turn , the heavier water will impact the side of the box instead of hitting the filter head on .
I also recently installed an AiRaid CAI on my cruiser and it came with a warning to be careful about driving through water.
The black silencer is more than twice the area of the white one , if it restricts it's minimal in comparison.

I've been driving the past 1 1/2 years with that black silencer removed and a 2" hose running from the opening next to the driver side fog light up to the fenderwell hole for the airbox snorkle. This provides cold outside air to the airbox. I live in Oregon where it can rain quite a bit for 9 months out of the year. I've never had a problem with water getting up into the airbox. That black silenser is not a flow through type. You don't realize how much it restricts the airflow until you see it out of the airbox. You can't tell anything from looking at it in the airbox. The three silencers in the intake system were put there to restrict the air flow and make it quiet for those folks who don't like noise. Is it going to hurt those people who want to keep it stock? No, it won't. But, for those of us who aren't stock the intake system along with the exhaust system must both be opened up.
