Last information I heard a while back was that the pedestrian was in critical condition, but that was a while back.

This article at Snopes says "As of 2 June 2004, Tegtmeyer (the pedestrian) was reported as being in serious condition at Miami Valley Hospital"

"Investigators said that at the time of the accident the crosswalk signal was red, and therefore Tegtmeyer should not have been crossing the street. They also reported that Tegtmeyer miraculously escaped alive because the dent in the side of the Subaru caused by the crash created a hollow space that allowed the vehicle to roll over him without crushing him to death. Neither vehicle was carrying any passengers, and both drivers escaped with only minor injuries."

The photos with the rain drops and dark backgrounds were taken in cloudy/rainy weather. Digital camera set to 1/1000 second and F/8 with the flash on.

The 1/1000 and F/8 serves to underexpose everything that is out of range of the flash, giving the dark background, and the flash gives the crisp highlights on the raindrops.
