Last information I heard a while back was that the pedestrian was in critical condition, but that was a while back.

This article at Snopes says "As of 2 June 2004, Tegtmeyer (the pedestrian) was reported as being in serious condition at Miami Valley Hospital"

The photos with the rain drops and dark backgrounds were taken in cloudy/rainy weather. Digital camera set to 1/1000 second and F/8 with the flash on.

The 1/1000 and F/8 serves to underexpose everything that is out of range of the flash, giving the dark background, and the flash gives the crisp highlights on the raindrops.
