Hi folks. I have been contacted by a lawyer in California looking for anyone who rented a PT Cruiser in California prior to December 1, 2007. Perhaps some of you had rented one to go to a west coats event or on business? If you ever traveled to California and rented one, you may want to contact him. I am enclosing his correspondence on the matter.
------------------------------------------------------------------------
Thank you for your time in listening to me today. Following up on our
phone conversation, the following is a summary of what is going on and
what I'm trying to do.
In August 2006, I filed a class action lawsuit against Avis and Budget
rent a car companies (both owned by the same parent company). The
suit was for their illegal and deceptive practices in selling their
"loss damage waiver" for PT Cruisers at $15 per day, when the maximum
amount allowed by California law was only $9 per day. The suit
alleged that as a result of their unlawful conduct, Avis and Budget
collected millions in illegal overcharges from the unsuspecting rental
public.
Unfortunately, the person who was our class plaintiff unexpectedly
died recently, leaving us without a representative rental customer to
carry on the lawsuit. In searching for a "replacement" plaintiff, I
immediately thought of attempting to contact PT Cruiser clubs around
the country, assuming that when its members traveled for business or
pleasure, they might want to try to rent a PT Cruiser, if one was
available.
In order to continue, I need to find another rental customer who meets
the following criteria:
1. A person who rented a PT Cruiser from Avis and/or Budget in
California prior to December 1, 2007 (after I filed my lawsuit, Avis
and Bubget started charging the correct rates as of that date).
2. The rental should have been made in one of the California
metropolitan areas, e.g, Los Angeles, San Diego or San Francisco bay
area from a Avis/Budget corporate location (generally meaning that the
car was rented from the "airport" office of one of these companies).
3. And that the renter purchased and paid for the "loss damage waiver"
at the rate of $15 per day, and preferably charged on a personal
credit card or paid for in cash.
If any of your club members meet these criteria, I would appreciate
hearing from them. If I am unable to find someone, Avis and Budget
will literally escape all liability and keep a lot of unlawfully
collected money.
I can explain in much greater detail of what would be involved, what
can be expected and what type of renumeration the class representative
can expect for his/her role in this matter.
If you can circulate this request among your members to see if anyone
is interested, I would be greatly indebted to you. I again thank you
for whatever assistance you can provide.
