Default I hate SUV's - they should be outlawed!

So I'm at lunch in my 12 week old GT. I get ready to back out of a parking place and check to the right, left and in my rear view mirror. Not a car in sight, so I ease out on the clutch. I back up maybe 5 feet and look again in the rear view mirror just in time to see a big-ass black Cadillac Escalade backing out of the space behind me at full speed! SMASH-CRASH-BAM!

Soccer mom says gee, I guess it's my fault, I didn't see you! She says she was in a hurry to get $80.00 worth of sandwiches back to the office for a meeting.

I look at the Caddy, and there's a spot where the dirt is rubbed off the bumper. I look at my GT and the rear fender is crushed, the taillight is smashed, the rear hatch is buckled and the bumper covering is cracked.

The police came and said that since the accident happened in a private parking lot, with no witnesses, they could not determine fault or cite the other driver! So my insurance has to pay my damage and her insurance has to pay her damage (!?).

So now thje best part; the damage to my car is $3,000.00 and it will be laid up for 7 working days getting repaired![:0]

gsharrock,

Maybe the police can't assess the blame, but you and she can! Since she so much as admitted the blame by saying that she was sorry but she didn't see you, then you should file the claim against her insurance. I do hope you swapped insurance info. Been there, done that! Let your insurance company go after her insurance for recompensation, and keep it from raising your rates.

gsharrock,

I feel your pain (I almost got hit last week). But let's not blame the SUV (that comes standard with rear sensors) but let's blame the Soccer Mom who shouldn't be behind the wheel of a Truck in the first place. Don't get me wrong, I think many women should drive Trucks and SUVs (my wife does), but others should not. Just don't blame the SUV, only blame the driver.

my condolences, i've experienced a similar incident before. My worst one was being hit by some drunk a$$ hole in a minivan. Who proceeded to take off over the curb and around the corner. Luckily the pizza guy behind me followed him and came back with his plate. The cops found him on his front porch, keys in the ignition, driver doot wide open, and basically completely incoherent. Did you go to a dealer body shop for the estimate??? If so, i'm sure you could find a better price...

file a claim with the other ladies insurance co. for (DEMINISHED VALUE) this is a way to recupe some extra money, bc you can't say your car has never been wrecked. so by law this a way to make up some of the loss that you will accure when you sell or trade it in.

I hate SUV's, too. Here in Oregon there are a lot of them and most SUV drivers drive like idiots. They drive fast and loose as if they were driving sports cars. Even if I am doing 75mph in a 65mph zone they wiz by me like I am standin still or ride my a$$.

Is it a rule that the smaller a soccer mom is, the larger the SUV she has to drive?

That's why I carry my digi-cam in my car.Never know when you might need it. When I was run off the road back in April, the guy never even stopped, and caused me to hit a Toyota Tundra head-on doing about 60.I spent 11 days in the hospital, and not counting my car, the other guy's truck, and his medical bills, just *my* bills totaled over $120,000 so far.Count yourself lucky.
Oh, by the way, since the guy never stopped, the asshole Trooper wrote the report to say thaty I drifted off the road, over-corrected, and came across and hit the other driver, so *I* was ticketed! I am fighting it in court as we speak and going for trial on a count of 'Failing To Maintain Lane' on September 22nd. I will be requesting a Jury Trial.

I don't know which insurance company it is but in New York, one of the insurance companies are handing out disposable cameras to its clients. If involved in an accident they want you to take pictures and give them back the camera. Not a bad idea as long as you aren't at fault.
