Default oil breather emission legal??

hey guys....i recently got a ticket for my oil breather filter. You know the one that replaces the stock tube running to the stock airbox from the valve cover. Is this emissions legal or not??? I believe it is illegal if it is a crank-case breather...if this IS what it is i guess i'm just screwed. But the ticket is for $380 CAN, so i'd rather try and get off. Thanks for any input...[^]

Don't think it's legal...why not install catch can in line then, dump back in the filter ?

Yes I too found out the hard way. The system must be a "closed loop" and cannot vent into the outside air. you can still purchase a "catch can" and put it in the middle of the stock hose.

yeah i am taking it to court...Nov 10th. The officer was from MTO and part of the P.A.C.E.R. program--Police And Community Educating Racers. The latest gestapo type hit squad around toronto. They are FULLY certified, and are called in by regular police when they pull over a modded car. They are very thorough and now their stuff. They even have an emissions testing van with a full machine in the back. But yeah i'm just gonna fix it and go to court and hopefully it's dropped.

I need to jump in here. I don't understand the part
about venting into the atmosphere. An engine is nothing more than a large air pump. The crankcase has to have an inlet and outlet. How can anyone say that the intake side is emitting, it's drawing. Thats what the opposite end is for(PCV). I could understand their theory on older vehicles before PCV. They had an intake side where the engine drew in its air, and a road tube that usually came out of the block and ran down to a point somewhere near the bottom of the engine. This vented the crankcase emissions.

I have my intake side vented to a paper filter to atmosphere, and thats where its going to stay. The more you close up an engine, the worse its going to run. Its gotta breath! The better it breaths, the better it will run. Try this one time, close your mouth and one nostrile and see how far you can run!

If you live somewhere that they check on this, I would try my best to route the hose differently so they can't pick up on it. Try hooking it back up to your stock box, but put a black plastic tee in the line where it's not noticeable and hook it to one of the small paper filters. Just place the filter in a place where they can't see it without hunting for it.

Actually, the inlet air (we call it make-up air) flows backwards under boost (crankcase pressure is definitely positive). This is where the oil comes from, and why you might choose to put an oil catch can in. If it isn't plumbed to a slight vacuum source (the air box), it is venting to atmosphere....
